My father was crossing the street and was hit by a car, and isnt going to make it. can i sue?

Were in the hospice house now just waiting for my father to pass. He's going to die as a direct result from this accident. The police report said she was "adjusting vehicle controls" when she hit him. She was going 30 in a 25 mph zone when she struck him. On the report the Drug column was checked yes (for her). Can I sue? Any suggestions of lawyers in Bristol Tn or VA that will only charge me if I win? I don't have money to afford anything really. If I can sue how much should I sue for?
